Rajasthan HC Quashes FIR, Observes Doctors Unlikely to Commit Negligence That Could Jeopardize Career and Finances

The Rajasthan High Court quashed an FIR against doctors of Vasundhara Hospital, Jodhpur, over the death of Priyanka Bishnoi after fibroid surgery. The complainant alleged lapses like skipping essential pre-operative tests and delaying a CT brain scan. However, District and State-level Medical Expert Committees found no prima facie evidence of gross negligence. The Court stressed that criminal liability arises only in cases of reckless or culpable conduct, not for adverse medical outcomes. It observed that doctors are unlikely to act negligently as it would damage their professional and financial standing. Accordingly, FIR No. 388/2024 and related proceedings were set aside.
